Terms of Service

These Terms of Service (the “Terms”) govern your use of the Poke AI iOS application and the website at pokeaiapp.com. Together with the jurisdictional schedule applicable to your residence, and the Privacy Policy, they constitute the agreement between you and the operating entity (the “Sponsor”).

1. Who can use Poke AI

You must be at least 18 years old and resident in an eligible jurisdiction. Eligible at v1: United Kingdom, Ireland, New Zealand, Canada (excluding Quebec), United States (excluding Washington state), and Australia.

Permanently blocked: Quebec, Washington state, Germany, Belgium, and all OFAC-sanctioned jurisdictions.

2. What we offer

2.1 Subscription Product

Scanner, vault, alerts, discover. Billed by Apple In-App Purchase. You manage cancellation in iOS Settings → Apple ID → Subscriptions.

2.2 Packs Product

Paid sealed digital packs that deliver one real Pokemon TCG card each, from a server-side pool curated by us. Five tiers ($15-$200). Pack purchases are processed by Stripe via Apple Pay (PassKit), not by Apple IAP, because the card is a physical good.

Operator buyback is not offered and will never be offered. Poke AI does not and will not buy cards back from users at any percentage, in any form, at any phase. The only outflows are: (a) Hold the card in our vault, (b) Ship the card to your address (subject to Section 4), or (c) when peer Marketplace launches in a future release, List for sale to other users (Poke AI acts as venue only, never as counterparty).

Each tier's pool has a published value cap, odds bands (filler / mid / chase), and a SHA-256 commit hash that is publicly verifiable at pokeaiapp.com/packs/verify once the pool is sold out.

2.3 Meowth Sweepstakes

A monthly bundled-free draw for one high-grade real Pokemon card. Active Subscription holders receive one auto-entry per draw at no charge. A no-cost Alternative Method of Entry (“AMOE”) is available to anyone at pokeaiapp.com/sweepstakes/free-entry and by post to a per-jurisdiction PO box (see schedule).

No purchase necessary. Equal odds for all entrants. We never sell additional entries for money under any circumstance. No quantity of pack purchases, subscription payments, or any other transaction increases your entry count beyond the bundled benefit per Subscription period.

Draws are deterministic and publicly verifiable at pokeaiapp.com/sweepstakes/verify.

3. Payments

Pack and shipping payments are processed by Stripe via Apple Pay PassKit, in your local currency, with tax handled by Stripe Tax based on your billing address.

Subscription payments are processed by Apple In-App Purchase. Apple's terms govern the transaction.

Sweepstakes entries are free under all circumstances. No payment ever processes against a sweepstakes entry.

4. Shipping

Three options: Free batch shipping (available when your vault has at least 15 cards or at least $50 FMV combined); Express PWE at $7.99 (untracked); Insured BMWT at $11.99 (tracked and insured; mandatory for any single card with FMV ≥ $50).

Per-card cap of $250. Cards with FMV exceeding $250 cannot be physically shipped (we cannot reliably source-and-replace at that price spread). You may Hold them, or when peer Marketplace launches, List them.

All shipments originate from our UK fulfillment partner. International transit times vary; we publish estimated delivery windows per destination at ship-confirm time.

Exception for Meowth Sweepstakes winners only: the prize ships free, insured, signature required, paid by us.

5. Refunds

Per jurisdictional schedule. If we fail to source a pulled card for physical shipment within 72 hours of your ship request, we refund 100% of the pack price and ship a comparable substitute card.

6. Provenance and chain of custody

We source cards from established secondary-market dealers and verified eBay sellers. Every card entering our pool is visually inspected before pool publication. Sweepstakes prizes are professionally authenticated where the value warrants. If you suspect integrity issues with a card you received, contact us within 14 days of physical delivery; we will inspect and replace.

7. Acceptable use

You will not: misrepresent your country of residence; create multiple accounts to game odds; reverse-engineer the rip mechanism beyond what is publicly verifiable; use the product in a blocked jurisdiction; commit fraud.

8. Geo-restrictions

Apple Pay billing country and Stripe customer country are verified at every transaction. T&Cs disclaim blocked jurisdictions. KYC at first shipment cross-references address country against the allowed list. Subscribers in blocked regions can still use the scanner-only feature set where lawful but cannot purchase Packs nor enter the Sweepstakes.

9. Intellectual property

Pokémon, Pokémon TCG, Meowth and related names and logos are trademarks of Nintendo / The Pokémon Company / Creatures Inc. / Game Freak. Use here is nominative only, to describe the cards we resell. We claim no Pokémon IP.

The Poke AI app, website, software, brand, and original content are our intellectual property and protected by applicable copyright and trademark law.

10. Privacy

Our processing of your data is governed by the Privacy Policy. KYC data collected for sweepstakes winner verification or high-value shipment verification is retained for 90 days post-completion per GDPR / equivalent, then destroyed.

11. Liability

We provide the service “as is”, subject to the consumer-law guarantees of your jurisdiction. We do not exclude liability for fraud, death, personal injury caused by negligence, or any liability that cannot be excluded by law in your jurisdiction. Our aggregate liability in any 12-month period is capped at the greater of (a) the amount you paid us in that period, or (b) the consumer-law minimum applicable in your jurisdiction.

12. Disputes and governing law

The governing law and forum are set out in your jurisdictional schedule. We participate in any consumer dispute scheme mandated in your jurisdiction.

13. Marketplace (coming later)

When peer Marketplace launches, Poke AI acts as venue only. We do not buy cards from users. We do not become counterparty to a marketplace transaction. Operator buyback is permanently excluded from all current and future versions of the product. This is a structural feature of the business, not a phasing decision.

14. Account

One account per natural person. You may delete your account in Settings → Account → Delete Account. We may suspend accounts for breach, fraud, or two consecutive Apple-initiated pack refunds (which trigger a permanent purchase block).

15. Changes

Material changes prompt an in-app re-acceptance screen. We publish the live version at this URL and the iOS app reads it on launch and before every purchase. The version tag at the top of this page is the canonical version.

This is the master text. The schedule for your residence jurisdiction prevails over any conflicting clause above. Where any clause is invalid in your jurisdiction, the remainder remains effective.
